Adoption of Official Plan Amendement

TAKE NOTICE that the Council of the Corporation of the County of Perth adopted Amendment No. 142 to the County of Perth Official Plan by By-law No. 3428-2014 under the provisions of Sections 17 and 21 of the Planning Act, R.S.O. 1990 at a meeting of Council on the 6th day of November, 2014.

Official Plan Amendment (OPA) No. 142 affects all lands in the County of Perth. OPA No. 142 incorporates general changes to incorporate policies for secondary residential units, requirements for complete applications, as well as the updated generic regulatory lines of the Conservation Authorities under Ontario Regulation 97/04, specifically Ontario Regulations 147/06 (Ausable Bayfield Conservation Authority), 150/06 (Grand River Conservation Authority), 157/06 (Upper Thames River Conservation Authority), and 164/06 (Maitland Valley Conservation Authority), as amended.

OPA No. 142 has been adopted by County Council following its review and consideration of an Official Plan Amendment application initiated by the County of Perth.

AND TAKE NOTICE that any person or agency may appeal the County’s decision to approve Amendment No. 142 to the County of Perth Official Plan to the Ontario Municipal Board by filing with the Clerk of the County of Perth not later than the 9th of December, 2014 a notice of appeal setting out the objection to the Official Plan Amendment and the reasons in support of the objection and accompanied by the proper fee.

Amendment No. 142 to the County of Perth Official Plan is exempt from the approval by the Ministry of Municipal Affairs and Housing. The decision of the Council of the Corporation of the County of Perth to adopt Amendment No. 142 to the County’s Official Plan is final if a notice of appeal is not received before or on the last day for filing a notice of appeal.

A copy of Amendment No. 142 is available for review at the Perth County Planning and Development Department (County Court House, 1 Huron Street, Stratford) during normal office hours.

NOTES:
1. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

2. No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
